1. Scope
These Terms and Conditions and Terms of Use apply to the use of the Minecraft server “CherrySMP”, the associated webstore, and all related digital content, digital goods, digital services, community offers, and server features.
These terms apply in addition to the applicable terms of Tebex, Minecraft, Mojang, Microsoft, Discord, and any other third-party providers used in connection with the server or the webstore.
If purchases are processed through Tebex, the terms displayed during checkout by Tebex and the respective payment providers also apply to the payment and purchase process.
2. Provider and Role of Tebex

Payments in the webstore are processed through Tebex and/or through the payment providers shown during checkout. Tebex may act as seller, payment processor, or merchant of record. The information displayed to the buyer during the checkout process is decisive.
The server operator is responsible for providing the server-related digital benefits, ranks, content, and services, insofar as these are used on the Minecraft server.
3. Definitions
Digital goods are non-physical content or benefits provided within or in connection with the Minecraft server. This includes, in particular, ranks, cosmetics, virtual currencies, keys, crates, tags, permissions, effects, particles, special commands, memberships, or other server-related benefits.
Digital services are services provided electronically or within the server, for example unlocks, configurations, memberships, time-limited benefits, or special community features.
A player is any person who uses the Minecraft server, the webstore, the Discord server, or any other community offers.
4. Requirements for Use
A valid Minecraft account is required to use the server. The player is responsible for maintaining access to their Minecraft account and keeping their login credentials secure.
The server is not officially affiliated with, sponsored by, or approved by Mojang, Microsoft, or Minecraft. Minecraft is a trademark of its respective rights holders.
Minors may only make purchases with the consent of their legal guardians. By completing a purchase, it is confirmed that the required consent has been obtained.
5. Subject of the Agreement
The offered services consist of digital, server-related goods and services. No physical goods are delivered.
The player does not acquire ownership of digital goods. The player only receives a personal, non-transferable right of use for the respective Minecraft account used for the purchase.
Sharing, reselling, transferring, renting, auctioning, or commercially using purchased digital benefits is not permitted unless expressly approved in writing.
6. Conclusion of Contract and Payment Processing
The display of products in the webstore does not constitute a legally binding offer by the server operator, but rather an invitation to place an order through the respective checkout process.
The exact conclusion of the contract, payment processing, payment methods, taxes, fees, and invoicing are governed by the terms displayed during checkout by Tebex and the respective payment providers.
The player is required to provide correct information when making a purchase, in particular the correct Minecraft username, the correct UUID, or any other required account data.
Incorrect information may cause delays or result in digital benefits not being provided or not being provided correctly.
7. Delivery of Digital Goods and Services
Digital goods are usually delivered automatically after successful payment.
In individual cases, delivery may be delayed for technical reasons, for example due to server issues, maintenance, plugin errors, payment checks, or incorrect information provided by the player.
A digital good is considered delivered once it has been technically assigned, activated, or made usable on the server for the specified Minecraft account.
If a purchased product is not delivered or is delivered incorrectly, the player must contact support at info@cherrysmp.store and provide the following information:
- Minecraft username
- Purchase date
- Transaction number or payment confirmation
- Purchased product
- Description of the issue
The server operator will review valid delivery issues and resolve them within a reasonable period of time.
8. Prices, Changes, and Availability
The prices displayed in the webstore at the time of purchase apply.
The server operator may change, remove, or expand products, prices, content, packages, and benefits for future purchases.
There is no entitlement to a specific product being offered permanently.
Digital benefits that have already been delivered generally remain available unless technical, legal, security-related, or balancing-related reasons require an adjustment.
9. Withdrawal and Refunds
Consumers may have statutory withdrawal rights. Details are provided in the withdrawal instructions shown during checkout and in the terms of Tebex or the respective seller.
For digital content or digital services, the right of withdrawal may expire early if the consumer has expressly agreed that performance of the contract begins before the withdrawal period expires and has confirmed that they thereby lose their right of withdrawal.
Statutory consumer rights, warranty rights, and mandatory legal claims remain unaffected.
Refunds are not generally excluded. Refund requests are reviewed in accordance with legal requirements, Tebex terms, and the circumstances of the individual case.
As a rule, there is no entitlement to a refund if the service was properly delivered and the player was excluded from the server due to a culpable violation of these terms, the server rules, or applicable law. Statutory rights remain unaffected.
10. Subscriptions and Time-Limited Services
If products are offered as subscriptions or time-limited services, the durations, renewal terms, and cancellation options displayed in the webstore and during checkout apply.
Subscriptions can be cancelled using the functions provided by Tebex or through the respective payment provider.
After a subscription or time-limited service ends, the associated benefits may automatically expire.
11. Virtual Currencies, Keys, and Crates
Virtual currencies, keys, crates, loot boxes, points, or similar content have no real-world monetary value and cannot be paid out in real money.
Payouts, transfers outside the server, or conversion into real money are excluded.
Virtual content may only be used within the server and in accordance with the server rules.
Where probabilities for crates, loot boxes, or comparable systems are relevant, they will be displayed transparently in the webstore, in-game, or in another suitable form.
12. Server Rules and Player Conduct
Every player is required to follow the server rules.
The following actions are especially prohibited:
- Cheating, hacking, unauthorized clients, or unauthorized modifications
- Exploiting bugs, exploits, or technical errors
- Duping, fraud, or manipulation of the server economy
- Real-money trading outside the official store
- Insults, threats, harassment, or discriminatory behavior
- Evading bans, mutes, or other sanctions
- Attacks against the server, website, Discord, team members, or players
- DDoS threats, extortion, phishing, or account theft
- Publishing private data of other persons
- Abuse of purchases, chargebacks, or payment data
- Disruption of server operations or the community
The server operator may take appropriate measures in the event of violations. These include, in particular, warnings, mutes, temporary bans, permanent bans, removal of individual permissions, resets of game progress, or exclusion from community offers.
The measure depends on the severity, repetition, and impact of the violation.
13. Bans, Suspensions, and Removal of Digital Benefits
A ban or suspension may result in purchased digital benefits no longer being usable.
In the event of serious or repeated violations of server rules, these terms, or applicable law, access to the server may be permanently revoked.
In such cases, there is no automatic entitlement to a refund. Statutory rights remain unaffected.
If a player was banned incorrectly, they may contact support. The case will be reviewed.
14. Server Availability
The server operator strives to provide stable and accessible server operations. However, permanent and uninterrupted availability is not guaranteed.
Maintenance, updates, technical issues, attacks, plugin errors, hosting problems, or force majeure may cause outages or restrictions.
In the case of longer or significant outages, the server operator may voluntarily offer compensation, extensions, or replacement services. An entitlement to this exists only where required by law.
15. Changes to the Server, Game System, and Balancing
The server is an ongoing project that is continuously developed. Game mechanics, economy systems, rewards, items, ranks, permissions, worlds, rules, and features may be adjusted if this is required for balancing, security, fairness, technical stability, legal reasons, or further development of the server.
The server operator will reasonably consider the legitimate interests of players.
There is no entitlement to unchanged game mechanics, unchanged values, or permanently identical benefits, provided that the adjustment is objectively justified and reasonable.

The player must provide truthful information and relevant proof when submitting support requests, for example transaction number, payment confirmation, Minecraft username, purchase date, or screenshots.
Abusive support requests, threats, insults, or false information may be rejected.
17. Chargebacks, Payment Fraud, and Abuse
Unauthorized chargebacks, payment fraud, use of third-party payment data, or other abuse may result in suspension of the affected account and removal of purchased digital benefits.
The server operator and Tebex may review such cases and forward them to payment providers or responsible authorities.
The player’s statutory rights remain unaffected.
18. Intellectual Property
All server-owned content, concepts, texts, graphics, logos, builds, configurations, names, designs, and other content are, where legally protectable, the property of the server operator or the respective rights holders.
Use, reproduction, distribution, or commercial exploitation without prior consent is not permitted.
The rights of Minecraft, Mojang, Microsoft, Tebex, Discord, and other third-party providers remain unaffected.
19. Data Protection
Information on the processing of personal data can be found in the server’s privacy policy as well as in the privacy notices of Tebex and other integrated third-party providers.

20. Liability
The server operator is fully liable in cases of intent, gross negligence, injury to life, body, or health, and according to mandatory legal provisions.
In cases of slight negligence, the server operator is liable only for breaches of essential contractual obligations. In this case, liability is limited to foreseeable damage typical for this type of contract.
Liability for statutory consumer rights remains unaffected.
For disruptions, outages, or damages outside the responsibility of the server operator, the server operator is liable only in accordance with legal provisions.
21. Changes to These Terms
The server operator may amend these terms with effect for the future if objective reasons exist. Objective reasons include, in particular, legal changes, technical changes, new features, security reasons, changes to the business model, or adjustments to server operations.
For purchases already completed, the terms effective at the time of purchase generally apply unless mandatory reasons require a change.
Players will be informed in an appropriate manner of significant changes.
22. Dispute Resolution
The server operator is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board unless there is a legal obligation to do so.
23. Applicable Law
The law of the Federal Republic of Germany applies, excluding the United Nations Convention on Contracts for the International Sale of Goods.
For consumers, this choice of law applies only insofar as it does not restrict mandatory consumer protection provisions of the country in which the consumer has their habitual residence.
If the purchase contract is concluded through Tebex, the terms specified during Tebex checkout may additionally apply.
24. Final Provisions
If individual provisions of these terms are or become invalid, the validity of the remaining provisions remains unaffected.
The statutory provisions shall apply in place of the invalid provision.
These terms apply from the effective date stated above.
